Mercy Congregation – Update On Contributions Made To Redress (2002) And Voluntary Contribution Post Ryan Report (2009)

The Congregation contributed property and cash, measured in excess of €33,000,000 pursuant to the Indemnity Agreement of 2002.

In December 2009, the Congregation issued a Contribution Document which set out details of its voluntary offer of contribution in response to the publication of the Ryan Report. That voluntary offer had 4 constituent parts:

1. The Congregation committed to the payment of €20 million in cash. The Congregation discharged this commitment punctually and voluntarily paid an additional €930,993.75 (which comprised the interest accrued on the €20 million sum, while awaiting the establishment of a statutory fund by the State).

2. The Congregation committed to transfer 16 properties with a December 2009 estimated value of €15,060,000, to the voluntary sector.

14 of those properties have transferred, one was declined by the intended recipient, and one is in progress. The one outstanding property transfer in this category has taken longer to complete, as input is required from a number of government departments and agencies, with which the Congregation is actively engaging on an ongoing basis.

3. The Congregation committed to sell 17 properties on the open market and to donate the proceeds of sale to a statutory fund to be established by the State pursuant to the Residential Institutions Statutory Fund Act 2012.

16 of these properties have transferred and the sales proceeds have been donated to the fund indicated by the State. The final property in this category could not be transferred as it was being used by the State to facilitate access to an adjacent State property during a time of development work. That use by the State recently came to an end and an auctioneer has been instructed to put the property on the market.

4. The Congregation committed to transfer 17 properties with a December 2009 estimated value of €80,856,800 to the State.

As of this date, 16 of these transfers are complete (one of which changed to being an open market sale, with funds transferred to the statutory fund). The remaining property transfer now falls within the second category mentioned above and is in progress, as described earlier.

The Congregation is continuing to do all in its power to complete the two outstanding property transactions that arise under the Contribution Document.
